Terms of Service

Effective and last updated: July 31, 2026

These Terms govern access to CMO AI. By creating an account or using the service, you agree to these Terms and represent that you have authority to bind the applicable business or organization.

Service

CMO AI provides marketing-data connections, multi-agent analysis, recommendations, research, briefs, reporting, memory, and approval workflows. Features depend on configured providers, valid credentials, available platform data, and third-party API access.

Your accounts and authority

You must provide accurate account information, protect credentials, and use only workspaces and marketing accounts you are authorized to access. Workspace owners control membership and roles. You are responsible for activity through your account.

Human approval and marketing decisions

CMO AI is decision-support software. AI output may be inaccurate, incomplete, or unsuitable. You must review recommendations, claims, targeting, budgets, creative, compliance, and proposed changes. Actions capable of spending money or changing a live account are designed to require explicit human approval; approval remains your business decision.

Connected platforms

Use of Google, Meta, Microsoft, LinkedIn, TikTok, CRM, email, and other connected services remains subject to those providers' terms, policies, permissions, quotas, reviews, and fees. CMO AI cannot guarantee continuing platform API access.

Acceptable use

You may not violate law or platform policy; access accounts without authorization; distribute malware; evade security or approval controls; generate deceptive claims; infringe rights; or interfere with the service.

Your data

You retain ownership of information you submit and grant CMO AI the limited rights needed to host, process, transmit, and analyze it to provide and secure the service. You are responsible for having the rights and notices required for connected data.

Availability and disclaimers

The service is provided on an “as available” basis. To the maximum extent permitted by law, CMO AI disclaims implied warranties and does not guarantee uninterrupted operation, marketing performance, revenue, ranking, attribution accuracy, or third-party availability. CMO AI does not provide legal, tax, or financial advice.

Liability

To the maximum extent permitted by law, CMO AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profit, lost data, ad spend, or platform-account action. Liability that cannot be excluded is limited to the amount paid during the three months before the event giving rise to the claim.

Changes and contact

We may update these Terms and will post the revised date. Questions may be sent to joeyharnist@yahoo.com.
